The Palm Beach County State Attorney's Office is being asked to use the state's new "anti-riot" law when charging a man accused of defacing an LGBTQ pride crosswalk.

20-year old Alexander Jerich was arrested after video surfaced of a truck appearing to purposely leave giant skid marks all over the rainbow-colored intersection in Delray Beach.

Palm Beach County Human Rights Council President Rand Hoch says the request is not going too far.

"I did not write the law. I read the law and it applies. I don't think it's a stretch whatsoever."

The legislation has a provision that enhances criminal penalties for people who damage "historic property" or a "memorial."

The crosswalk was dedicated to the victims of the Pulse Nightclub shooting.

The State Attorney's Office says "any statutes applicable to the facts of the case will be considered for filing of formal charges" in the case.

Jerich has pleaded not guilty.
